Deputy prosecutors general

They occupy the highest hierarchical rank of the magistracy of the Public Prosecution Service, to which state prosecutors may accede only by way of merit [article 148(1) of the Statute of the Public Prosecution Service/SPPS].

According to the Statute, a deputy prosecutor general holds office:

— as Vice-Prosecutor General [article 174(1) of the SPPS]

— as Regional Deputy Prosecutor General [articles 67(1) and 173 of the SPPS]

— at the Superior Courts [article 172(1) of the SPPS]

— at Court of Appeal and Central Administrative Courts [article 8(1)(b)) SPPS], under the direction of the Regional Deputy Prosecutor General [article 57(2) and 164(1)(2) of the  SPPS]

— as director of the Central Department of Criminal Investigation and Prosecution/CDCIP [articles 57(2), 164(1)(2) of the SPPS]

— at the Inspection of the Public Prosecution Service [article 169(1) of the SPPS]

— at the Consultative Council of the Prosecutor General’s Office [article 170.1 of the SPPS]

— as Legal Auditor [articles 51 and 171 of the SPPS]

— at Regional Deputy Prosecutors General’s Office [article 67(7) of the SPPS]

— as coordinator of the County District Prosecutor's Office [articles 73(3) and 162(1) of the SPPS]

— as director at Regional DCIPs [article 160(1)(2) of the SPPS]

— as director at DCIPs County District Prosecutors’ Offices [articles 86(2) and 159 of the SPPS]

— at the Administrative and Tax State Prosecutors’ Offices [articles 88 and 161(1) of the SPPS]

— as director of the Central Department of State Litigation and Collective and Diffuse Interests [articles 62 and 165(1) of the SPPS]

— as director of the Technologies and Information Systems Department [article 166(1) of the SPPS]

— as director of the Department of Judicial Cooperation and International Relations [articles 54(5) and 167(1) of the SPPS]

— as director and member of the National Coordination Offices [articles 55(4) and 168 of the SPPS]

— at the first instance courts [articles 8(1)(c), and 82 of the SPPS)

Deputy prosecutors general placed in the Supreme Court of Justice, the Constitutional Court, the Supreme Administrative Court and the Court of Audit have the same rank, treatment and honour as those of the judges who perform their duties and they use the same professional attire (article 110 (3) of the SPPS).

The regional deputy prosecutors general and the coordinating magistrate of the Administrative and Tax State Prosecutors’ Offices have the same rank, treatment and honours as those of the presidents of the courts of appeal and the central administrative courts and they use the same professional attire (article 110(4) of the SPPS)

The other deputy prosecutors general, namely those placed in the Appellate Courts and the Central Administrative Courts, have the same rank, treatment and honour as those of the judges who perform their duties and wear the professional attire they are entitled to (Article 110(5) of the SPPS)
