The Prosecutor General's Office

The Prosecutor General’s Office (PGO) is the highest body of the Public Prosecution Service [1], and it comprises the Prosecutor General [2] as its president, the High Council of the Public Prosecution Service [3], the Consultative Council of the Prosecutor General’s Office [4], the Legal Auditors [5] and the Technical and Administrative Support Services [article 220(1), (2) of the Constitution of the Portuguese Republic/CPR, articles 9(1),(2), 11, 12(1/a) the Statute of the Public Prosecution Service/SPPS]

The following departments operate under its authority [article 9(3) of the SPPS]

  • the Central Department of Criminal Investigation and Prosecution [6] (CDCIP)
  • the Cybercrime Office [7]
  • the Information Systems Coordination Bureau [8] (ISCB)
  • the Bureau of Documentation and Comparative Law [9] (BDCL)
  • the Collective and Diffuse Interests Unit [10]
  • the Technical Advisory Unit [11] (TAU) 

In general, its powers are listed in article 10 of the SPPS and in article 219(5) of the CPR. For a global overview see the powers conferred to its various components:

  • the Technical and Administrative Support Services: article 50 of the SPPS; Decree-Law No. 333/99 of 20 August 1999 

Apart from being a complex body, the Prosecutor General’s Office is also the central authority for the international judicial co-operation in criminal matters [16] and for the apostille [17], as well as a supervisory entity as regards the legal regime applicable to incompatibilities and impediments of senior public officeholders [18]. The Data Oversight Commission of the Portuguese Republic Intelligence System [19] has its seat at the Prosecutor General’s Office.
